This website, including rockleighservices.com, rockleighservices.com.au, its pages and enquiry forms (the Website), is operated by Rockleigh Services Pty Ltd, trading as Rockleigh Services.

These Terms & Conditions (Terms) apply to your use of the Website. They govern the Website only and do not replace the terms of any quotation, scope of work, work order or other project agreement.

Website information

We take reasonable care to keep the information on the Website accurate and current. However, the information is general and may change as our services, availability and operating requirements change.

The suitability, scope, timing, availability and price of our services must be confirmed for each project. Nothing on the Website constitutes a site-specific engineering, legal, financial or safety assessment.

Enquiries, quotations and services

Submitting an enquiry through the Website is a request for information only. It does not oblige either party to proceed and does not, by itself, create a contract.

If you submit an enquiry for another person or organisation, you confirm that you are authorised to do so.

Any engagement will be governed by the relevant quotation, scope of work, work order or other agreement issued by Rockleigh Services and accepted in the manner stated in that document.

To the extent of any inconsistency, the applicable project agreement will prevail over these Website Terms, subject always to the Australian Consumer Law and other rights that cannot lawfully be excluded.

You are responsible for providing accurate and complete information about your enquiry, project and site conditions. Please tell us if relevant information changes.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

Where applicable, consumer guarantees may include requirements that services are provided with due care and skill, are reasonably fit for a disclosed purpose and are supplied within a reasonable time.

Acceptable use

You must not use the Website:

  • For unlawful, fraudulent or misleading activity.
  • To impersonate another person or misrepresent your authority.

If you send us plans, photographs, specifications, documents or other materials through the Website, you confirm that:

  • You are authorised to provide them.

You give Rockleigh Services a limited, non-exclusive permission to use those materials solely to assess, respond to and administer your enquiry. You retain ownership of your materials.

Any additional permissions required for project work will be addressed in the applicable project agreement.

If you provide personal information through the Website, we may collect and use it to respond to your enquiry and manage our communications with you.

Our website and enquiry-service providers may process that information on our behalf. We handle personal information in accordance with applicable privacy laws and any collection notice displayed when the information is collected.

Please do not include sensitive personal information in a general Website enquiry. If we require that information, we will request it separately and explain why.

Nothing in this clause limits the rights preserved by clause 4.

To the maximum extent permitted by law, Rockleigh Services is not responsible for loss caused by:

  • Unauthorised interference with the Website or its systems.
  • The failure or unavailability of third-party systems outside our reasonable control.

This clause applies only to use of the Website and does not limit obligations arising under a project agreement.

These limitations do not apply to the extent that loss is caused by our negligence, fraud, wilful misconduct, misleading or deceptive conduct, breach of a project agreement, or any liability that cannot lawfully be excluded.

Changes to these Terms

We may update these Terms to reflect changes to the Website, our operations or applicable law.

Updated Terms apply prospectively from the date they are published. The “last updated” date will be changed accordingly.

An update to these Website Terms will not vary an existing quotation or project agreement without the agreement of the relevant parties.

Governing law

These Terms are governed by the laws of South Australia, Australia.

Rockleigh Services and each Website user submit to the non-exclusive jurisdiction of the courts of South Australia. Nothing in this clause limits any right available under a mandatory law that applies to the user.

Severability

If part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.
